Terms of service
These terms apply when you use Without Notes: the website, the free test and its checks, your account, and anything you buy. By using the test or buying, you agree to them.
Without Notes is run by BD Nova UG (haftungsbeschränkt), Straße der Jugend 18, 14974 Ludwigsfelde, Germany (“we”, “us”). How we handle personal data is in the privacy notice.
Our billing rules
- Only the yearly full access renews, and it says so before you buy. We email you 35 days and 7 days before each renewal, and you can cancel in one tap at any time. 90 days is paid once and never renews.
- No free trial that turns into a plan. The free tier is the trial.
- No coins, hearts, gems or credits, and nothing sold inside a lesson.
- Anything you place stays yours to walk, check and export, forever, paid or not.
- Refunds within 14 days, with no questions.
- Prices include VAT where it applies.
- In the EU and the UK you can withdraw within 14 days, even from a one-time purchase.
These rules are part of these terms. If anything below seems to say otherwise, the rules win. “Forever” is explained in section 6.

1. Who can use it
You must be 16 or over to use Without Notes, and 18 or over to buy anything. Without Notes isn’t made for children or for schools, and we don’t market it to them. If we learn that someone under 16 is using it, we’ll close their account and delete their data. If you think someone under 16 is using Without Notes, email privacy@withoutnotes.com.
2. The free test and your session
You can take the test without an account. Your session stays in the browser you took it in. If you don’t save it, we delete it 30 days after your last activity. To keep it and get the checks, save it with your email address: we send you a sign-in link, and there is no password.
3. Your account
You sign in with your Google account or with links we email you, so anyone who can use that Google account or read your email can sign in. Keep both secure. An account is for one person; don’t share it or sell it.
You can delete your account at any time on your account page, or ask us to by writing to privacy@withoutnotes.com, and we’ll do it within 30 days. Deletion is permanent, so download a copy of your material first if you want one; the account page has that too. Deleting your account doesn’t by itself bring a refund; see refunds.
4. What Without Notes is
Without Notes is a study tool for memorising your own material with memory methods, spaced checks and walks. It is not medical advice, and it does not diagnose or treat memory problems. If you’re worried about your memory, talk to a doctor.
Results differ from person to person. A score shows what happened in one test or check, under the conditions shown next to it. It isn’t a promise about your memory, an exam, a talk or anything else that depends on it.
Full access includes pictures of your scenes (section 5.2), which you can switch off on your account page. When on, each one is drawn by a third-party AI model, OpenAI’s, from your scene’s sentence, and is labelled as an AI illustration. We check the sentence and the picture before you see it, but a picture can still be wrong, odd or unsuitable. If one is, use Report and we delete it. We don’t promise that any picture is accurate or fit for a particular use.
5. Free and paid
5.1 Free
The test and its checks are free. As the full app is built, every tool stays free, with the amount capped: your body’s ten places, the first lessons, any number of projects holding up to 10 of your own things between them (places and cards alike), each with its date, a people list of up to 15 names, and every walk, check and export, for good. Limits only ever apply to adding new things. We never limit or charge for walking, checking or exporting anything you’ve already placed.
5.2 Full access
What you can buy:
- Full access, 1 year: $49.99 or €49.99 a year. It renews each year until you cancel (section 10). No caps while it runs: every project, place and card, every lesson, the rooms we draw while it runs, and what’s described when you buy.
- Full access, 90 days: $14.99 or €14.99, paid once, the same for 90 days. It never renews: it simply ends.
- When full access ends, everything you placed stays yours to walk, check and export. Time bought while other full access runs starts when that ends, and a renewal adds its year after everything already paid for. You must be 18 or over to buy. Full refund within 14 days, with no questions.
- Illustrations of your own sentences are for people aged 18 and over, only if you switch them on, up to 10 a month.
6. What you buy, and if we close
What you buy is a personal, non-transferable licence to use the paid features for the time you paid for, not ownership of the software. “Forever” in these terms means only that what you placed stays yours to walk, check and export for as long as we run Without Notes. If we ever close Without Notes, we’ll tell you by email at least 90 days before, export will keep working until the day it closes, and we’ll refund the part of any pass that hasn’t run.
7. Prices, tax and payment
- Prices are shown before you buy. Prices in euros include VAT. Prices in dollars don’t include US sales tax: if it applies where you live, checkout adds it and shows it before you pay. There are no other charges from us: no delivery or activation fees. A renewal charges the year’s price you bought at. If we ever want to charge more, we’ll ask you by email 30 days before the renewal, and again 7 days before, with how to cancel. Unless you say yes, your subscription doesn’t renew at the new price and ends at the end of the year you’ve paid for. Your bank may charge for converting currency.
- Payment on the web is handled by Creem as merchant of record (section 17). Creem sells you the purchase, takes payment, issues the invoice in its own name, handles VAT and sales tax, and processes refunds and chargebacks. We never see your card details.
- Creem’s buyer terms apply to the payment. These terms apply to the service.
8. Refunds
- Full access, 90 days or a year: a full refund within 14 days of purchase, with no questions.
- Each renewal of the year: a full refund of that renewal within 14 days of it, with no questions. After that, cancelling brings back the whole months left of the year you paid for, as section 10 says.
- How to ask: reply to your receipt email, or write to support@withoutnotes.com with your order reference. Creem refunds the full amount to the way you paid, without undue delay and within 14 days of your request.
- After a refund the paid features end. Everything you placed stays yours to walk, check and export.
- After the refund window we don’t refund, except where the law requires it, for example if the service doesn’t work as described. Nothing in these terms limits your statutory rights.
9. Your right to withdraw
If you’re a consumer in the European Union, the EEA or the UK, you can withdraw from a purchase within 14 days without giving a reason (Article 9 of the Consumer Rights Directive 2011/83/EU; § 355 of the German Civil Code (BGB); the UK Consumer Contracts Regulations 2013). The 14 days start on the day you complete checkout.
Starting straight away. You can use what you bought as soon as payment is confirmed. That costs you nothing: you keep the full 14 days, and we don’t charge for the days you used.
If you withdraw, we refund everything you paid, with nothing deducted for use, without undue delay and no later than 14 days after your withdrawal reaches us. The refund goes to the way you paid, at no cost to you. The paid features then end, and everything you placed stays yours.
The right doesn’t end early, and we don’t ask you to give it up.
How to withdraw. Either:
- use Withdraw from contract here, which needs no sign-in, enter your name, the email address you bought with and your order reference, and confirm. We email you a confirmation of what you sent, with the date and time we received it; or
- tell us clearly that you’re withdrawing, by email to support@withoutnotes.com or by post to BD Nova UG (haftungsbeschränkt), Straße der Jugend 18, 14974 Ludwigsfelde, Germany. You can use the model form below, but you don’t have to.
Sending your notice before the 14 days end is enough. Our refund promise (section 8) gives the same 14 days to everyone, wherever they live.
Your contract for the service is with us, BD Nova UG (haftungsbeschränkt), and you withdraw from it with us, even though Creem processes the payment as merchant of record and makes the refund. A withdrawal that reaches Creem counts as received by us.
Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.
To BD Nova UG (haftungsbeschränkt), Straße der Jugend 18, 14974 Ludwigsfelde, Germany, support@withoutnotes.com:
I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service (*):
Ordered on (*):
Name of consumer(s):
Address of consumer(s):
Signature of consumer(s) (only if this form is notified on paper):
Date:
(*) Delete as appropriate.
Nothing in this section limits any right you have under mandatory consumer law.
10. Ending your contract
You can cancel at any time, without signing in, using Cancel contract here, the link in any renewal email, or by writing to support@withoutnotes.com; signed in, with Cancel renewal on your account page. We confirm every cancellation by email straight away, with the date and time it reached us and the day your full access ends. If a renewal is charged after your cancellation reached us, we refund it in full. Your account and everything you placed stay yours to walk, check and export, unless you also ask us to delete your account.
- Full access, 1 year, renews each year until you cancel. We email you 35 days and 7 days before each renewal, with the price, the date and a link that cancels it.
- In its first year, cancelling stops the renewal: full access runs to the end of the year you paid for, and nothing more is charged.
- Once it has renewed, your contract runs on with no fixed term, billed a year at a time in advance. You can end it at any time with effect at the end of the month in which your cancellation reaches us, and we refund the whole months left of the year you paid for. Within 14 days of a renewal we refund that renewal in full instead. If you only stop the renewal, full access runs to the end of the year you paid for.
- Full access, 90 days, never renews, so there’s no future payment to stop. Ending it after the refund window doesn’t bring a refund, unless the law requires one.
11. Information before you buy
This summarises the information EU law requires before a purchase (Article 6 of the Consumer Rights Directive; § 312d BGB):
- Who we are: BD Nova UG (haftungsbeschränkt), Straße der Jugend 18, 14974 Ludwigsfelde, Germany. Email support@withoutnotes.com. The full legal notice, with the commercial register, is in our Impressum.
- The service: as described in section 4 and section 5.
- Price: as in section 5: euros include VAT; any US sales tax is added and shown at checkout. No delivery or other charges.
- Payment: through Creem as merchant of record. We don’t store payment details.
- When you get it: as soon as payment is confirmed, before the 14-day withdrawal period ends. You keep the full 14 days (section 9).
- How long it lasts: 90 days, a single payment, from your purchase or from the end of full access still running; or a year, renewing each year at the same price until you cancel, ended as section 10 says. The first year is its only fixed term.
- Right of withdrawal: 14 days, with a full refund, using the withdrawal function at /withdraw or a message to us (section 9).
- Refunds: section 8. Ending the contract: section 10.
- Your statutory rights: the legal rights for digital products apply in full, including updates needed to keep the service working as described (in Germany, §§ 327 to 327u BGB).
- Complaints: support@withoutnotes.com for the service, legal@withoutnotes.com for legal matters. We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG).
- Language: these terms and the contract are in English.
12. Using Without Notes fairly
Without Notes is for your own individual use, through the app and website as we provide them. You agree not to:
- use bots, scripts or other automated means to use the service, or send requests at a rate no person could;
- get around rate limits, bot checks or any other security measure;
- copy or systematically extract the service’s content, such as lessons, rooms, art or word lists, or use it to train or build AI models;
- reverse-engineer the service, except where the law allows it;
- share your account, or sell or pass on access to it;
- store anything illegal, anything you have no right to use, or sensitive details about other people, such as their health, religion, sex life, political views or ethnic origin. For people you’re learning, a name and a short cue are enough;
- use the service to harass, track or harm anyone;
- disrupt the service or anyone else’s use of it;
- remove the AI label from a picture of your scene, or the mark in a saved picture’s file that says it was made with AI.
Please don’t keep PINs, passwords or card numbers in Without Notes. The app refuses lines that look like them.
If you break these rules, we’ll use the mildest step that stops the problem: a message asking you to stop, then a temporary limit, then a suspension, and for serious or repeated breaches, ending your account for good cause (§ 314 BGB). Where the law requires notice or a chance to put things right, you’ll get it. If we end your account for a breach, we don’t refund what you paid, unless the law requires it.
13. Your material
You own what you put into Without Notes. You give us a non-exclusive licence to store it, process it and show it back to you, including through our service providers, only to run the service for you, including exporting it when you ask. We don’t show it to anyone else, use it in marketing or use it to train AI models.
As far as we or OpenAI have any rights in a picture of your scene, they’re yours. A picture made from a short sentence may not be protected by copyright, and similar pictures may be made for other people.
You’re responsible for having the right to keep what you add, particularly material about other people or from your work. When you delete your account, we delete your material as the privacy notice describes.
No one who works on Without Notes looks at your material, except when you report a problem and ask us to, when the law requires it, or to deal with a request or report about it.
Requests and reports about material. Anyone can ask us to remove material about them, or report material they believe is illegal, by writing to privacy@withoutnotes.com (privacy notice, section 3). A person at BD Nova UG (haftungsbeschränkt) reads each one and decides; no automated system does. If we find the request well founded, or the material breaks section 12, we may remove that entry, and only that entry. If we do, we’ll email you which entry it was, why we removed it and how to object: reply to that email and we’ll look at it again, and you can also go to court (Digital Services Act, Article 17). Everything else you placed stays as it was.
14. Our content
The service, its design, the figure and rooms, the lessons, the word lists and the software belong to us or to those who license them to us. We give you a personal, non-transferable licence to use them through the service. You may not copy, change or build on them except as these terms or the law allow.
15. Changes to the service
We may change, update or remove features where there’s a valid reason: the law, security, preventing abuse, technical changes, fixing faults, improving the service, changes by providers we depend on, or keeping it running. Changes won’t cost you anything extra. If a change materially harms your access to or use of something you paid for, we’ll tell you clearly and in advance, and you can end the contract and get the refund the law gives you. We never take away anything you’ve placed, or charge you to recall it.
16. Warranty and liability
We work to keep Without Notes running and correct, but we can’t promise it will always be available or free of errors. Your statutory rights for digital products stay in full. Where the law of your country allows it, the service is otherwise provided as it is and as available.
Subject to the exceptions below, our total liability for all claims arising from or related to the service is limited to the greater of what you paid us in the 12 months before the claim, or €100. We aren’t liable for indirect or consequential losses such as lost profits, lost data or lost goodwill.
These limits don’t apply, and our liability is not excluded or limited:
- for harm we cause intentionally or through gross negligence;
- for injury to life, body or health caused by our negligence;
- under the German Product Liability Act (Produkthaftungsgesetz);
- where we’ve given a guarantee;
- for breach of essential contractual duties (duties that make proper performance of the contract possible and that you may regularly rely on) through ordinary negligence, where our liability is limited to the typical damage foreseeable when the contract was made;
- for any other liability that can’t be excluded or limited by law, including mandatory consumer protection law in the EU, the UK and the US.
17. Who sells you what
On the web, Creem. The merchant of record is Armitage Labs OÜ (registry code 16977866), Rotermanni 14, 10111 Tallinn, Estonia, which runs the Creem service. Creem is the seller of record for your purchase: it collects payment, issues the invoice in its own name, calculates and pays VAT and sales tax, and processes refunds and chargebacks.
Your relationship for paying is with Creem. Your relationship for the service, meaning what you get, support and the service itself, is with us. For billing questions (invoices, failed payments, refunds), reply to your Creem receipt or write to support@withoutnotes.com and we’ll pass it to Creem. As far as the law allows, we aren’t responsible for billing, payment or tax errors made by Creem; this doesn’t limit any right you have against Creem or us that can’t be waived.
In our apps, later. When Without Notes is in the App Store and Google Play, purchases made there will be sold by Apple or Google under their own terms, and refunds for them will go through Apple or Google. We’ll update these terms before that happens.
18. Disputes
18.1 In the EU and the EEA
These terms are governed by German law. If you’re a consumer living in another EU or EEA country, this doesn’t take away the protection of the mandatory laws of your country (Article 6(2) of Regulation (EC) No 593/2008, “Rome I”). You can bring proceedings against us in the courts where you live or where we’re registered. We can bring proceedings against you only in the courts where you live.
18.2 In the UK
These terms are governed by German law, but you keep the protection of the mandatory laws of the part of the UK where you live, and you can bring proceedings in your local courts.
18.3 In the United States
If you have a dispute with us, please write to legal@withoutnotes.com first: most things can be put right that way. These terms are governed by German law, but nothing in them limits or waives your rights under mandatory US federal or state consumer protection law. You can bring proceedings in the courts where you live, including small-claims court.
18.4 Everywhere else
These terms are governed by German law. If you’re a consumer, you keep the protection of the mandatory consumer laws of the country where you live. Disputes go to the courts where we’re registered, unless mandatory local consumer law says otherwise.
19. Suspension and termination
We may suspend or end your account if you break these terms (section 12), if you abuse the service, or if the law requires it. We’ll give reasonable notice where we can. Afterwards, we handle your data as the privacy notice describes.
20. Changes to these terms
If we change these terms in a way that matters, we’ll email everyone who has saved at least 30 days before the change takes effect, and show it on the site. A change never takes away what you’ve already paid for. If you don’t agree, you can end your contract (section 10) before the change takes effect.
21. Copyright complaints
If you believe something on our site or in the service infringes your copyright, write to legal@withoutnotes.com or to BD Nova UG (haftungsbeschränkt), Straße der Jugend 18, 14974 Ludwigsfelde, Germany. Under the US Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), a notice must include your physical or electronic signature; the work you say is infringed; the material you say infringes it, with enough detail for us to find it; your contact details; a statement that you believe in good faith that the use isn’t authorised; and a statement, under penalty of perjury, that your notice is accurate and that you’re the owner or authorised to act for them. If your material was removed by mistake, you can send a counter-notice under 17 U.S.C. § 512(g) to the same address. We close the accounts of repeat infringers where appropriate.
22. General
If any part of these terms is found unenforceable, the rest stays in force, and that part is changed only as much as needed to make it enforceable while keeping its purpose.
